Terms & Conditions

If you choose our ‘UPFRONT’ option, the following Terms and Conditions apply:

In accordance with the terms of The Estate Agents Act 1979 and orders made under it we set out below certain information regarding our charges for Estate Agency Services, the circumstances in which they will arise, when they become due for payment, and other relevant information.

AGREED CHARGES

  1. Upfront fee with nothing further to pay on completion. (Payable within 30 days from the date of 365 Invoice. Non-Refundable) Photographs, erection of ‘For Sale’ board, property listings on Propertypal.com, Propertynews.com and 365estateagents.co.uk.
  2. SUBSEQUENT OUTLAY (Payable within 30 days from date of 365 Invoice. Non-Refundable) Any subsequent outlay will be agreed and confirmed with you prior to being incurred. Additional outlay which you may agree to incur could include, for example, press advertising, additional photographs and video tours, brochures etc.

WITHDRAWAL or CANCELLATION

  1. This Agency Agreement expires upon either party giving the other 14 days notice in writing, subject to the following:

All Agreed Charges as detailed in Clauses 1 & 2 above are non-refundable and any outstanding amounts are payable within 10 days from the date of the withdrawal or cancellation.

  1. The vendor has a 14 day cooling off period. If at any time within a 14 day period of signing this agreement, the vendor changes their mind for whatever reason then this contract can be cancelled by giving a cancellation notice to 365 Estate Agents.

OTHER RELEVANT INFORMATION

  1. Under The Property Misdescriptions Act 365 must ensure that all information regarding the property is accurate and does not mislead. The Vendor(s) undertake to immediately advise 365 should they become aware of any inaccuracies and/or misdescriptions either in the brochure, websites, or in any written or verbal communication.
  2. As part of the Estate Agency process 365 may offer prospective purchasers the full range of Estate Agency services including, but not restricted to, the valuation of their present property and a sales service.
  3. 365 reserve the right to retain any discounts they may receive resulting from advertising, editorial, or features in the Press or other media and also any other discounts they may negotiate separately with other Suppliers of goods or services. These discounts normally arise out of bulk purchase arrangements and prompt payment by 365.
  4. The payment terms are clearly set out in Clauses 1-4 above and 365 reserve the right to charge interest from day to day at the annual rate of 3% above Bank of England base rate on any amounts outstanding beyond the due dates.
  5. 365 are not responsible for the maintenance or repair of any unoccupied property unless by specific written agreement.
  6. It is a requirement of The Estate Agents Act that 365 disclose to any prospective purchaser any business or family relationship between the Vendor(s) and 365.
  7. 365 are appointed as Sole Agent and until this Agency Agreement is terminated the Vendor(s) agree that they will not instruct another Agent to sell the property.
  8. Under the Money Laundering Regulations 365 are required to collect and retain two forms of ID before listing or marketing a property in any way, as follows:
  9. Current full Passport, Current UK/EU Drivers Licence, Resident Permit issued by Home Office, State Pension/Benefits Book
  10. Most Recent Mortgage Statement, Local Tax Authority Bill, Local Authority Rent Card, Current UK/EU Drivers Licence, Utility Bill

If you choose either of our ‘PAY ON COMPLETION’ options, the following Terms and Conditions apply:

In accordance with the terms of The Estate Agents Act 1979 and orders made under it we set out below certain information regarding our charges for Estate Agency Services, the circumstances in which they will arise, when they become due for payment, and other relevant information.

AGREED CHARGES

  1. Initial MARKETING PACKAGE (Payable within 30 days from the date of 365 Invoice. Non-Refundable) Photographs, erection of ‘For Sale’ board, and extensive online marketing.
  2. SUBSEQUENT OUTLAY (Payable within 30 days from date of 365 Invoice. Non-Refundable) Any subsequent outlay will be agreed and confirmed with you prior to being incurred. Additional outlay which you may agree to incur could include, for example, press advertising, additional photographs and video tours, brochures etc.
  3. SALE FEE (Payable within 10 days from date of completion of sale of the property)The Sale Fee is payable by the Vendor(s) to 365 in either of the following circumstances:

A: If unconditional contracts for the sale of the property are concluded or are in the course of being concluded in the period during which this Agency Agreement is in force whether or not the Purchase is introduced by 365.

B: If unconditional contracts for the sale of the property are concluded after the expiry of this Agency Agreement to a purchaser who was introduced directly or indirectly by 365 whilst the Agency Agreement was in force or to a purchaser with whom 365 had negotiations about the property during this period.

  1. This Agency Agreement expires upon either party giving the other 14 days notice in writing, subject to the following:

A: No Sale Fee is payable apart from that which may arise under the terms of Clause 3 above. In the event of no Sale Fee being payable 365 reserve the right to apply a service charge of up to £250 which is payable by the Vendor(s) within 10 days from the date of the withdrawal or cancellation.

B: All Agreed Charges as detailed in Clauses 1 & 2 above are non-refundable and any outstanding amounts are payable within 10 days from the date of the withdrawal or cancellation.

SPECIAL PROVISIONS The Vendor(s) hereby give authority to their Solicitors acting in the sale to pay the Sale Fee direct to 365 upon completion date of the sale.
